Terms and Conditions

These terms and conditions apply to your use of the RaiseTheMoney.com website and all associated services. This is an agreement between you and Raise the Money, Inc. These terms and conditions apply to your use of our services available under the domain and sub-domains, and API integrations of www.raisethemoney.com (the “Site”), including but not limited to Raise The Money, and the general principles for the Web sites of any subsidiaries. If you do not agree to be bound by the terms and conditions of this Agreement, you may not use or access our services.

Acceptance

To conduct a transaction with a candidate or committee on the site, you must read, agree with, and accept all of the terms and conditions contained in this Terms and Conditions Agreement and Privacy Policy. By agreeing to these Terms and Conditions and by using the site to process a transaction, you agree to be bound by all municipal, state, and federal law related to the processing of your financial transaction.

Definitions

“Raise The Money,” “RTM,” “We,” and “Our” refer to Raise the Money, Inc.

“You” and “Yours” refers to you personally acting in your own interest or on the behalf of another entity for which you are authorized to act.

“Candidate” refers to a political candidate for public elected office and sub-merchants of RTM who use our site to raise funds or otherwise process financial transactions online.

“Committee” refers to a political campaign committee and sub-merchants of RTM who use our site to raise funds or otherwise process financial transactions online.

“Contributor” refers to a person or entity that makes a political campaign contribution to a candidate or committee and processes that transaction on the site. “Site” refers to www.raisethemoney.com.

“Your information” refers to any information you provide to us or other users in connection with your use of the site.

These terms of use include our privacy policy.

Candidate Finance Laws & Reporting

Political contributions are governed by campaign finance laws. Raise The Money makes its best effort to ensure that all contributions made using RaiseTheMoney.com are in accordance with these laws. Nonetheless, you have final responsibility for ensuring your own compliance.

Raise The Money will not permit users to make contributions larger than $5,200 to any federal candidate. However, Raise The Money does not track users' contributions through other avenues (e.g. fundraisers, candidates' websites). Therefore you (and not Raise The Money) are responsible for ensuring that your total contributions through these different avenues do not exceed your contribution limits. You as the candidate or committee are responsible for filing timely campaign finance reports with the FEC or applicable state agencies.

Fees and Services

Creating an account with RTM is free. Contributions are processed at a rate of 4.9% + $0.25 per transaction. For each month in which you receive a contribution your account will be charged a $7.99 Financial Report fee for the collation, archival and retrieval of your donors’ individual contribution data.

Permissions and Reuse

RTM is a payment service provider. Our payment services are only available to, and may only be used by, individuals who can form legally binding contracts under applicable law.

Candidate or Committee Account Approval Process

In order to process candidate or committee contributions through Raise The Money.com, you will be required to provide information regarding the candidate or committee you are authorized to represent. Raise The Money will (but is not limited to) collect the following information about you and your business entity:

    • Zip, Postal Code, Postcode
    • Phone
    • Website
    • Social Insurance Number (SIN)
    • Photo ID
    • Date of Birth
    • ID Number
  • Organization Type:
    • 501 c3 Registered non-profit
    • Political candidate
    • Other non-profit group
    • For profit organization
  • Are you currently accepting credit cards (yes / no)
    • If yes, with whom?
    • Annual Transaction volume
    • Average Transaction amount
  • Administrative Contact
    • Name
    • Email
    • Phone
  • Banking Information:
    • Bank / Financial Institution name
    • Routing number, Bank State Branch (BSN) Number, Bank Identifier Code
    • Checking Account number, Bank Account number, International Bank Account number
    • Bank Contact Name
    • Bank Contact phone number

Upon collection of this information, Raise The Money will conduct a sub-merchant approval process to validate your submission and the information provided about your candidate or committee. Raise The Money may (but is not limited to) use one or more of the following forms of validation:

  • Personal and / or Organization Credit Check
  • SSN verification services
  • ID verification services
  • Website review
  • 501c3 registration services
  • Public records search
  • Contact your banking provider
  • Verification of political candidate status

Upon completion of this process, Raise The Money will either notify you if your account is in good standing and that you are authorized to process transactions, or if Raise The Money has not approved your fundraising account request. Raise The Money reserves the right not to approve account requests for any reason.

Remittance & Refund policy

Deposits to your bank account will be made 2 to 3 business days after a contribution is made.

To initiate a refund on a transaction back to a contributor, contact support@raisethemoney.com. Raise The Money will not issue a refund for reasons such as a change in political opinion, the loss of an election, or the cancellation of an event. All refund requests are subject to the availability of the contribution funds.

Our time limit to offer your refund is 45 days after the transaction date. After 45 days, RTM will no longer be able to issue a refund and you will need to contact the candidate or committee directly. RTM reserves the right to hold funds for the use of refunds.

All refunds issued by Raise The Money will be credited back to the card used to make the contribution. In all cases where we are not able to accommodate a refund request, we will be happy to refer you to the recipient of your contribution so that you may request a refund directly from them.

If you are with a candidate, committee, or organization that has received a contribution through Raise The Money and would like to request that we refund that contribution, please contact us at support@RaiseTheMoney.com.

License to Contributor Data

All non-encrypted data provided by a contributor is your property. You may export this data from the site.

Disclaimer of Warranties and Limitation of Liability

This site is provided by Raise the Money on an “as is” and “as available” basis. Raise the Money makes no representations or warranties of any kind, expressed or implied, whether based upon the nature of merchantability, fitness for a particular purpose, or otherwise, as to the operation of this site, or the accuracy, timeliness, or completeness of information, content, materials, or services included on this site. You expressly agree that your use of this site and any information contained herein is at your sole risk.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

You agree to hold Raise the Money, Inc., harmless from any and all liabilities, losses, actions, damages, or claims (including all reasonable expenses, costs, and attorney fees) arising out of or relating to any use of, or reliance on, this website.

Under no circumstances will Raise the Money, Inc., be liable to you, or any other person or entity, for any loss of use, revenue, or profit, lost or damaged data, or other commercial or economic loss, or for any direct, indirect, incidental, special, statutory, punitive, exemplary or consequential damages whatsoever related to your use of this service or access to this webpage, even if advised of the possibility of such damages or if such damages are foreseeable. This limitation shall apply even in the event of a fundamental or material breach or a breach of the fundamental or material terms of this agreement.

Agency

RTM is not your agent. You and RTM are independent contractors. You and RTM have no partnership, joint venture, employee-employer or franchiser-franchisee relationship. RTM will act solely on your behalf as your agent to process the transaction from your contributor.

Any Notices shall be given by U. S. Mail to RTM at P.O. Box 26466, Little Rock, AR 72221.

Changes to Terms and Conditions

As we develop this site we may need to update the policies described above. Changes will be posted here.

General Terms

This agreement shall be governed by the laws of Arkansas. This agreement represents the entire agreement. The services hereunder are offered and provided by Raise the Money, Inc., located at P.O. Box 26466, Little Rock, AR 72221.
